General Terms & Conditions


1. Scope of Services

SMAILD is a cloud-based service operated by taroza.pro that enables users to send invoices, payment reminders, and other business documents by physical post directly from their bexio account. The service integrates with bexio and uses Pingen for letter delivery, who in turn uses Swiss Post, DPD and/or other mailing services.

By using SMAILD, you agree to these General Terms and Conditions. These terms govern the relationship between you (the "Customer") and taroza.pro (the "Provider").

2. Registration and Account

To use SMAILD, you must have a valid bexio account and authorize SMAILD to access your bexio data. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must provide accurate and complete information during registration. You agree to update your information promptly if it changes.

3. Service Usage

SMAILD allows you to send documents via different delivery methods including A Mail, B Mail, and registered mail. The actual postal delivery is performed by Pingen. SMAILD acts as an intermediary that processes your documents and submits them to Pingen for printing and delivery.

You are solely responsible for the content of the documents you send. You must ensure that your use of the service complies with all applicable laws and regulations, including data protection laws.

4. Pricing and Payment

SMAILD operates on a subscription model with additional per-letter fees. Current pricing is displayed on our website. The Provider reserves the right to change prices with reasonable notice.

Payment is processed through our payment provider. By using the service, you authorize recurring charges according to your selected plan. Fees are non-refundable unless otherwise required by law.

5. Service Availability

The Provider strives to maintain high availability of the service but does not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible. The Provider is not liable for temporary unavailability due to technical issues, maintenance, or circumstances beyond its control.

6. Limitation of Liability

The Provider is not responsible for delays or failures in postal delivery caused by Pingen or other third parties. The Provider's liability is limited to the fees paid for the affected service.

The Provider does not guarantee that letters will reach their intended recipients or that payment reminders will result in payment. The service is provided "as is" without warranties of any kind, except as required by law.

The Provider is not liable for any indirect, incidental, or consequential damages arising from the use of the service, including but not limited to lost profits, business interruption, or data loss.

7. Data Protection

The processing of personal data is governed by our Privacy Statement. By using SMAILD, you acknowledge that document data will be transmitted to Pingen for printing and delivery purposes.

8. Termination

Either party may terminate the service agreement at any time. Upon termination, access to the service will be revoked. Outstanding fees remain due and payable. The Provider may terminate or suspend access immediately if you violate these terms.

9. Amendments

The Provider reserves the right to modify these terms at any time. Changes will be communicated via email or through the service. Continued use of SMAILD after changes take effect constitutes acceptance of the modified terms.

10. Applicable Law and Jurisdiction

These terms are governed by Swiss law. Any disputes arising from or relating to these terms or the use of SMAILD shall be subject to the exclusive jurisdiction of the courts at the Provider's place of business in Switzerland.
